2012 MLB.com Postseason Bracket Challenge: Official Rules

Introduction

The object of MLB.com Postseason 2012 Bracket Challenge (the "Contest") is to select the MLB teams you think will win each series of the 2012 Major League Baseball ("MLB") postseason. For purposes of this Contest, the "Postseason Series" shall mean, collectively, the Wild Card Games ("Wild Card"), American League Division Series ("ALDS"), the National League Division Series ("NLDS"), the American League Championship Series ("ALCS"), the National League Championship Series ("NLCS") and the World Series. To enter, you must complete an online postseason bracket by selecting, for each Postseason Series, the MLB teams you think will win. Your goal is to use your skill and knowledge of Major League Baseball to try to pick the winners of each Postseason Series.

Eligibility

The Contest is open only to legal residents of the fifty (50) United States, Washington D.C. and Canada (excluding residents of the Province of Quebec) who are of legal age of majority in their jurisdictions of residence (and at least eighteen (18) years of age) as of the date of entry with a valid e-mail address and Internet access as of October 2, 2012. Void in the Province of Quebec and where prohibited by law, rule or regulation.

Employees, officers and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and any person residing in their same households, whether or not related) of the MLB Entities (defined below), Choice Hotels International Services Corp., Choice Hotels International, Inc. franchisees,  and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Contest, are not eligible to participate or win a prize. The "MLB Entities" shall mean MLB Advanced Media, L.P. ("Sponsor," "MLBAM" or "MLB.com"), the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs, Tickets.com, Inc., SportsOnEarth, LLC and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the shareholders, parents, directors, officers, representatives, employees, agents, successors and assigns of the above entities.

How to Register

You may register to participate in the Contest from 12:01 a.m. Eastern Time ("ET") on October 4, 2012 through five (5) minutes prior to the start of the first game of the Postseason Series on October 5, 2012 (the "Registration Period"). Online entry only. No other method of registration will be accepted. Limit one (1) bracket per valid MLB.com account, per person and per email address. In case of multiple registrations received from any person, only the first registration received from such person will be considered. To register to participate, during the Registration Period visit either www.mlb.com/fantasy or www.facebook.com/mlb (the "MLB Facebook Page") and click on the banners, buttons and/or links to access the Contest registration page (the "Contest Registration Page"). If you are not already a member of MLB.com, you must become one before you can register to participate in the Contest (membership is free). To access the Contest Registration Page on the MLB Facebook Page you will need to be logged in to your Facebook account and click "Like" on the MLB Facebook Page. All entry data provided via the Facebook entry form is provided to MLB.com and not to Facebook. Registrations must be received during the Registration Period to be eligible. All entries must include a valid e-mail address for the participant. Please note that all information submitted by participants is subject to, and will be treated in a manner consistent with, MLB.com's Terms of Use accessible at http://mlb.mlb.com/mlb/official_info/about_mlb_com/terms_of_use.jsp and Privacy Policy accessible at: www.mlb.com/privacy. Entries generated by script, macro or other automated means or utilizing any other method or means which, in MLBAM's sole discretion, impacts the integrity of the Contest or is in violation of these Official Rules are void. Entrants to the Contest may be given the option to receive commercial e-mails from MLB.com and/or its affiliates; however, eligibility to participate in the Contest is not dependent upon entrant's consent to receive such e-mails.

Contest Administration

By registering and/or participating in the Contest, each participant agrees that MLBAM will solely resolve any disputes and rules violations that arise in connection with the Contest. All decisions by MLBAM regarding the Contest shall be final and binding in all respects. Any incidence of collusion or cheating, as determined by MLBAM in its sole discretion, will be subject to disqualification from the Contest without limitation to any other rights or remedies available to MLBAM. Filling out your bracket

Each Postseason Series match-up will be posted on MLB.com after all ten (10) MLB teams participating in the 2012 MLB Postseason have been confirmed. Follow the instruction provided to select and drag the logos of the MLB teams that you think will win each Postseason Series into place within the online bracket.

If at any time before the Lock Time (defined below) you wish to start your bracket over, simply hit the "Reset" button located below the bracket to clear your previous team selections. New pick selections will not be saved until you re-submit your bracket.

Selecting Tiebreakers

In addition to filling out your bracket, you must also select an answer to each of the following tiebreaker questions:

1. Total number of runs you think will be scored during the final game of the World Series;

2. Total number of hits you think will be recorded during the final game of the World Series;

3. Total number of runs you think will be scored during the entire World Series; and

4. Total number of hits you think will be recorded during the entire World Series.

Note: Only wins officially scored as wins in the 2012 Postseason Series will be counted in the Contest.

Team Selection Deadline

The deadline for selecting your bracket is five (5) minutes prior to the start of the first game of the Postseason Series scheduled to begin on October 5, 2012 (the "Lock Time"). If you fail to submit a bracket before the Lock Time, you will not be eligible to participate in the Contest. MLBAM's computer shall be the official clock of the Contest. Once you have submitted your bracket, you may change your selections at any time prior to the Lock Time.

Scoring

Scoring in the Contest is as follows: You will receive points for each Postseason Series for which you correctly select the winning team, as determined by MLBAM in its sole discretion based on official results, as follows:

Since there are nine (9) total Postseason Series results (i.e. two (2) Wild Cards, two (2) ALDS, two (2) NLDS, one (1) ALCS, one (1) NLCS, one (1) World Series), any eligible participant can receive a maximum of one hundred and five (105) points.

The eligible participant who achieves the highest total score based on the results of their bracket, as determined by MLBAM in its sole discretion based on official results, will be the official winner of the Contest (the "Grand Prize Winner"), subject to verification of eligibility and full compliance with the terms of these Official Rules.  In the event of a tie for the Grand Prize, the Tiebreakers (defined below) will be used among the remaining tied participants to determine one (1) Grand Prize Winner.  IN NO EVENT WILL MORE THAN ONE (1) GRAND PRIZE BE AWARDED.

Grand Prize

The Grand Prize Winner will receive (a) one thousand U.S. dollars (USD $1,000), (b) two (2) tickets for the Grand Prize Winner and one (1) guest (the "Guest") to attend one (1) game of the 2013 MLB World Series championship selected in Sponsor’s sole discretion (the "World Series Game"), (c) two (2) round trip coach class air transportation for the Grand Prize Winner and Guest from a major commercial airport nearest Grand Prize Winner's home in the U.S. to a major commercial airport nearest the host city of the World Series Game, (d) one (1) standard hotel room (double occupancy) for two (2) nights in a hotel selected by Sponsor in or near the host city of the World Series Game ((a), (b), (c), and (d) collectively, the "Grand Prize"). Approximate Retail Value ("ARV") of the Grand Prize: $4500. Actual value of the Grand Prize will vary depending on Grand Prize Winner's city of departure and the host city of the World Series Game. All Grand Prize details, including exact World Series Game and seat locations at the World Series Game, shall be determined in the sole discretion of Sponsor. GROUND TRANSPORTATION NOT INCLUDED.

GRAND PRIZE WILL NOT BE AWARDED IF NO PARTICIPANT ACHIEVES A SCORE GREATER THAN OR EQUAL TO TWENTY FIVE (25) POINTS.

GRAND PRIZE CONDITIONS:  Grand Prize Winner is fully responsible for any and all applicable federal, state, provincial and local taxes (including income and withholding taxes). All costs and expenses associated with the Grand Prize acceptance and use not specified herein as being provided including, but not limited to, any and all expenses incurred by accepting the Grand Prize are the sole responsibility of the Grand Prize Winner. The cash portion of the Grand Prize will be awarded in the form of a check in U.S. dollars as one (1) lump sum. The Grand Prize is non-transferable and non-assignable, with no cash redemptions except at Sponsor's sole and absolute discretion. Sponsor reserves the right to substitute the Grand Prize (or any portion thereof) with one of comparable or greater value at its sole and absolute discretion. The flight selection will be at the discretion of Sponsor. Sponsor, in its sole discretion, reserves the right to provide ground transportation in lieu of air transportation if the Grand Prize Winner resides within one hundred (100) miles of the host city of the World Series Game (and no additional compensation or substitution will be awarded for difference in prize value). Trip must be taken on dates specified by Sponsor or the Grand Prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate potential winner may be selected from among all remaining eligible entries.  If the World Series Game or any other Grand Prize-related activity is canceled or postponed for any reason, travel prize will be awarded less applicable Grand Prize-related activity(s) and Sponsor will substitute that activity(s) with an item(s)/activity(s) of comparable or greater value as determined solely by Sponsor. Travel and hotel accommodation restrictions apply. Travel arrangements must be made through Sponsor’s agent and on a carrier of Sponsors' choice. Grand Prize Winner and Guest must travel together on the same itinerary and are responsible for obtaining all necessary travel documents (e.g., valid photo I.D and/or passports or visas if applicable) prior to travel. Tickets are subject to certain terms and conditions as specified by issuers. Grand Prize Winner’s companions must be of legal age of majority in their jurisdictions of residence (and at least eighteen (18) years of age), unless accompanied by a parent or legal guardian.  Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball may be subject to change.  The terms and conditions of the tickets awarded as part of the Grand Prize may govern in the event the World Series Game, event or exhibition, as defined by Major League Baseball, is not played due to weather conditions, an act of God, an act of terrorism, civil disturbance or any other reason.  Grand Prize Winner and his/her guest(s) agree to comply with all applicable ballpark regulations in connection with the Grand Prize.  Sponsor and the applicable MLB Entities reserve the right to remove or to deny entry to the Grand Prize Winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition.  Released Parties (defined below) will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition.  Major League Baseball game, event and exhibition tickets awarded as part of the Grand Prize may not be resold or offered for resale. Any such resale may result in disqualification and Grand Prize forfeiture, and may invalidate the license granted by the game ticket(s).

Tiebreakers

In the event of a tie for the Grand Prize, the following tiebreakers (the "Tiebreakers") will be used among the remaining tied participants in the following order:

1. Total number of runs scored during the final game of the World Series;

2. Total number of hits recorded during the final game of the World Series;

3. Total number of runs scored during the entire World Series;

4. Total number of hits recorded during the entire World Series; and

7. MLBAM will administer a timed baseball trivia quiz, testing the tied participants' knowledge of Major League Baseball, until the tie is broken.

The participant whose submission is closest to the correct answer will be deemed the winner of the applicable tiebreaker.

General Conditions

By registering and/or participating, each participant accepts and agrees to be bound by these Official Rules, the MLB.com Privacy Policy and Terms of Use, and by the decision(s) of MLBAM which shall be final and binding in all respects. Each potential winner will be notified by e-mail and/or telephone (in MLBAM's discretion) and may (in MLBAM's discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). Subject to verification of eligibility and compliance with the terms of these Official Rules, a potential winner will be declared an official winner. In the event that any potential winner does not respond to any such Prize Notification within five (5) days of date of issuance, a disqualification will result and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up (if applicable). Each potential winner will be required to submit his/her valid social security number and/or other identification to MLBAM and will be required to execute, have notarized and return an Affidavit of Eligibility (or, if a resident of Canada, a declaration) and Release of Liability and, unless prohibited by law, Publicity within five (5) days of date of issuance. Failure to submit any identification required by MLBAM or to return any required documents within the specified time period, noncompliance with these Official Rules or the return of any prize or Prize Notification as undeliverable may result in disqualification and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up (if applicable).

Each participant agrees to allow MLBAM and its designees to use their names and likenesses in any and all media or formats now or hereafter known for advertising and publicity purposes throughout the world in perpetuity, without any compensation, notification or permission unless prohibited by law. All applicable federal, state, provincial and local laws and regulations apply. This Contest and these Official Rules will be governed by the laws of the State of New York. Any court of competent jurisdiction sitting within the State of New York, New York County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these Official Rules. MLBAM's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The MLB Entities, Choice Hotels International Services Corp., Choice Hotels International, Inc. franchisees, and each of their respective parent companies, trustees, subsidiaries, franchisees, affiliates, licensees, agents, independent contractors, advertising and promotional agencies, and each of their respective officers, directors, agents and employees (collectively, the "Released Parties") are not responsible for lost, late, stolen, garbled, delayed, undelivered or misdirected entries, selections or registrations, for incorrect, inaccurate or incomplete entry information whether caused by a participant, equipment, or technical malfunction or for any human error, technical error or malfunctions.

Major League Baseball game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the applicable Major League Baseball Club, as applicable, and may be subject to change. The Released Parties will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster that may cause the cancellation or postponement of any Major League Baseball game.

Released Parties are not responsible for any technical, computer, network, typographical, printing, human or other errors relating to or in connection with this Contest, including, without limitation, errors or problems which may occur in connection with the offer or administration of this Contest, the processing of entries, selections or registrations, the tabulation of points, the cancellation of games or any errors appearing in any Contest related-materials, including, but not limited to, errors in advertising, the Official Rules, the selection and announcement of the prize winner or the distribution of the prizes. MLBAM reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.

The Released Parties make no warranties, express or implied, relative to the use or enjoyment of any prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. By entering the Contest, each participant agrees to indemnify, hold harmless and fully release the Released Parties and Facebook from any and all claims, demands, losses, promises, causes of action and liabilities for any injuries, losses, death, or damages of any kind caused, directly or indirectly, in whole or in part, by participation in, or preparation for, the Contest or resulting from the acceptance, possession, quality, use or misuse of any prize, or any portion of any prize, including any travel or any activity related to the receipt or use of any prize (or any portion thereof). This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. MLB.com Postseason Bracket Challenge is a skill contest designed to increase consumer awareness of and interest in Major League Baseball and MLB.com, the Official Site of Major League Baseball. This Contest may not be used for, or in connection with, any form of gambling.

For winner information (available after December 1, 2012), send a self-addressed, stamped envelope to: 2012 MLB.com Postseason Bracket Challenge c/o Melissa Wester, MLB Advanced Media, L.P., 75 Ninth Avenue, New York, NY 10011. Requests must be received by December 31, 2012.

Internet

If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, cancellation of games or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, MLBAM reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest and, if terminated, to determine the winners, if any, from among all eligible, non-suspect scores achieved up to the point of termination.

The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network , cable, satellite, wireless Internet Service Provider (ISP) or lines, computer systems, servers, or providers, computer equipment, software, malfunctions of wireless devices, wireless service problems, cellular tower equipment, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site or wireless service congestion, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MLBAM WILL DISQUALIFY ANY SUCH PARTICIPANT, AND MLBAM AND/OR ITS AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute as to the identity of a participant, an entry will be declared made by the Authorized Account Holder of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. "Authorized Account Holder" is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address for the domain associated with the submitted e-mail address.

In the event that the Contest is challenged by any legal or regulatory authority, MLBAM reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any participants who are disqualified due to such an action.
